HABERMAS Y LA PRODUCCIÓN DISCURSIVA DEL DERECHO

Resumen

This article analyzes Jürgen Habermas' discursive conception of right by focusing on one type of legal production that should not disengage from popular sovereignty, a characteristic of a radical democracy, nor from the processes of post-metaphysical foundation of civil rules. The right is for the German author, ultimately, a transformer in the circuit of global communication, which integrates both the functional-systemic component as well as the symbolic component of the lif eworld.
